MDS Advisory works with clients to manage risk and to avoid disputes wherever possible. When adjudication, arbitration or litigation are unavoidable, we focus on our client’s commercial objectives, while assessing legal, commercial and reputational risk. We analyse the negotiating weaknesses of opponents to identify procedural tactics or creative settlement approaches. 

We also carry out and support internal investigations under legal professional privilege.

Dispute Avoidance

Parties can fail to see eye-to-eye at any point. We not only help our clients plan to avoid potential pitfalls at contract stage but also regularly monitor progress to ensure the risk of dispute is kept to an absolute minimum.

This is often achieved with a contract management plan clearly communicating contractual terms, ensuring notices are issued in accordance with contract time scales, ensure programme forecasting and monitoring is properly maintained, ensuring appropriate records are in place.

Greenwich Village £100million Final Account Negotiation and Settlement

Engaged to review all dispute and settlement options for a large residential project in Greenwich, London. A settlement negotiation was entered into which included an audit of the project legal documentation and a Deed of Variation that affirmed some of the despite items in the contract documents. A full contentious dispute was avoided with a favourable and cost effective outcome for the client.
