MDS acts in intellectual property disputes

MDS Advisory has recently acted in copyright and trademark disputes in the High Court (Intellectual Property Enterprise Court) and before the Registrar in the Trademark Registry. This has proven familiar ground for Adam Oliver, Partner and Head of the firm’s Commercial and Corporate department, who spent the first 10 years of his career in the field, including roles with Granada Television (now ITV) and Sky Interactive.

It has been a pleasure to advise clients whom I have known for many years on the significant contentious and non-contentious copyright and trademark issues facing their businesses. The time we spend working on commercialising intellectual property for these clients, through licensing, distribution and production agreements means that I am generally familiar with the issues in any disputes that they occasionally face. It is reassuring to see how the legal system has kept up with technological developments, in particular on cross-border issues and nothwithstanding the UK’s exit from the EU. We have had significant recent success in enforcing the commercial positions that various clients have taken in relation to their assets, without allowing their costs to spiral.
