Dispute Resolution
MDS Advisory works with clients to manage risk and to avoid disputes wherever possible. When adjudication, arbitration or litigation are unavoidable, we focus on our client’s commercial objectives, while assessing legal, commercial and reputational risk. We analyse the negotiating weaknesses of opponents to identify procedural tactics or creative settlement approaches.
We also carry out and support internal investigations under legal professional privilege.
Litigation & Arbitration
MDS Advisory work through the whole dispute process from pre-action, through negotiation and mediation to arbitration and litigation and enforcement.
Following in-depth fact finding and risk analysis, our approach to each stage will be carefully considered and applied in-line with our client’s strategy and budget. Throughout the process, we will report and reassess regularly to ensure that we meet and exceed client expectations. We act in all types of civil disputes, including High Court and County Court claims, IP matters before Registrars, in tribunals, in the Technology and Construction Court (using our dual qualified resources in both law and surveying and our access to the Academy of Experts), in domestic and international arbitration forums.
It is important to point out that I originally approached a top tier law firm in the sector to get this outstanding bill paid. That turned out to be an expensive exercise with no resolution. However, it was your law firm, MDS Advisory, that quickly got into the detail of the issues and enabled us to resolve the dispute.
Your advice and preparation prior to the Mediation was first class and we have now received our payment without a continued expensive battle at litigation.
